Niniejszy Regulamin (dalej „Regulamin”) stanowi wzorzec umowny w rozumieniu art. 384 kodeksu cywilnego i określa prawa i obowiązki stron umowy o korzystanie z usług Unity Jiu-Jitsu Kraków. Regulamin stosuje się także do wszelkich akcji promocyjnych organizowanych przez Unity Jiu-Jitsu Kraków. Każda osoba korzystająca z usług Unity Jiu-Jitsu Kraków zawiera umowę z firmą UNITY JIU JITSU SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ z siedzibą w Krakowie, ul. Wielicka 42A/U3-U5, 30-552, posługującą się numerem NIP: 6793333520, REGON: 541996549, KRS: 0001177943. Treść niniejszego Regulaminu udostępniana jest na stronie internetowej Klubu, a także w siedzibie Unity Jiu-Jitsu Kraków mieszczącej się przy ul. Wielickiej 42A/U3-U5, 30-552.

Zaświadczam, że przeczytałam aktualny regulamin, nie wnoszę do niego uwag i akceptuję jego treść.

Oświadczam, że odtwarzanie lub brak odtwarzania jakichkolwiek utworów w klubie sportów walki Unity Jiu-Jitsu Kraków nie wpływa na moją decyzję o zakupie karnetu czy skorzystania z usługi.

§1 Słownik

1.Klub – klub sportów walki Unity Jiu-Jitsu Kraków mieszczący się przy ul. Wielickiej 42A/U3-U5, 30-552 Kraków

2.Umowa – zawarta z Podmiotem prowadzącym Klub umowa o korzystanie z usług Klubu, na warunkach wynikających z niniejszego Regulaminu

3.Klient – każda korzystająca z usług Klubu

4.Członek Klubu – osoba, która zawarła z Klubem umowę o korzystanie z usług Klubu na czas określony. Członkostwo potwierdzane jest przez posiadanie Karnetu

5.Karnet – karta klubowa wydawana przez Klub dla Członka Klubu upoważniająca go do brania udziału w zajęciach organizowanych przez Klub, także w formie aplikacji mobilnej lub internetowej

6.Trener – osoba prowadząca kursy z zakresu sportów walki

§2 Zakres usług

1.Klub świadczy usługi prowadzenia kursów z zakresu sportów walki.

2.Klient ma prawo do korzystania z usług Klubu na podstawie zawartej Umowy.

3.Korzystanie z usług Klubu możliwe jest zarówno na podstawie posiadania przez Członka Klubu opłaconego Karnetu lub poprzez uiszczenie w recepcji Klubu lub on-line jednorazowej opłaty zgodnie z obowiązującym cennikiem (wejście jednorazowe).

4.Klub oświadcza, iż Trenerzy posiadają wiedzę i doświadczenie odpowiednie do prowadzenia kursów z zakresu sportów walki.

5. Klub informuje, iż przedmiotem usługi jest możliwość skorzystania ze sprzętu znajdującego się na jego terenie. Zajęcia prowadzone w Klubie, są zajęciami technicznymi, opartymi o konkretną technikę lub elementy techniczne o charakterze sportowym.

6. Klub nie oferuje swoim klientom ćwiczenia z wykorzystaniem muzyki na zajęciach. Obecność muzyki lub jej brak w żadnym stopniu nie jest elementem usługi, a Klient Klubu deklaruje, że muzyka lub jej brak nie wpływa na decyzję o zakupie członkostwa, jednocześnie został poinformowany, że część osób zatrudnionych w Klubie słucha utworów dla poprawy własnego nastroju. Klient Klubu taką deklarację składa, podpisując oświadczenie znajomości i akceptacji regulaminu lub umowę.

7. Trener w Klubie prowadzi zajęcia techniczne. Wszelka muzyka wykorzystana w tle, jeśli jest używana to tylko i wyłącznie prywatnie przez Trenera w celu umilenia sobie czasu pomiędzy nauką poszczególnych pozycji.  Jest również dla wielu Trenerów sposobem na stres występujący podczas prezentacji przed grupą. Klient przyjmuje to do wiadomości, oświadczając jednocześnie, że nie wpływa to na jego decyzje zakupową co potwierdza podczas akceptacji Regulaminu i nie wnosząc do niego uwag.

§3 Usługi Członkowskie

1. Każdy kto ubiega się o zostanie Członkiem Klubu zobowiązany jest okazać dokument tożsamości zawierający fotografię celem weryfikacji tożsamości.

2. Każdy Członek Klubu otrzyma Karnet w recepcji klubu lub za pośrednictwem systemu internetowego WodGuru.

3. Karnet jest imienny i nie może być udostępniany innym osobom.

4. Członkowie Klubu są zobowiązani do okazywania swoich Karnetów za każdym razem, kiedy wchodzą do Klubu. Klub może odmówić Członkowi Klubu wejścia w przypadku, gdy ten nie okaże karnetu.

5. Każda ze stron Umowy jest uprawniona do wypowiedzenia Umowy ze skutkiem natychmiastowym z ważnych powodów, przez które strony rozumieją każdy z przypadków, gdy:

– Członek Klubu narusza postanowienia niniejszego Regulaminu i nie zaprzestaje naruszeń pomimo otrzymanego upomnienia ze strony kierownictwa lub personelu Klubu,

– Klub narusza postanowienia niniejszego Regulaminu i nie zaprzestaje naruszeń pomimo otrzymanego upomnienia ze strony Członka Klubu.

§4 Zasady korzystania z Klubu

1. Klient bierze udział w kursach organizowanych przez Klub oraz korzysta z wyposażenia Klubu wyłącznie pod nadzorem Trenera.

2. Przed przystąpieniem do korzystania z usług Klubu, każdy Klient jest zobowiązany złożyć oświadczenie o braku przeciwskazań zdrowotnych do brania udziału w zajęciach. W przypadku zaistnienia przeciwskazań, Klient ma obowiązek poinformować o tym fakcie Trenera. Oświadczenie należy złożyć w formie dokumentowej.

3. Klient zobowiązany jest do podporządkowania się poleceniom wydawanym przez Trenera i pracowników Klubu.

4. Trener ma prawo ograniczyć liczbę osób na zajęciach lub poprosić Klienta o opuszczenie kursu, jeśli, w opinii trenera, Klient ten nie przestrzega poleceń Trenera.

5. Zabronione jest wchodzenie na matę treningową w jakimkolwiek obuwiu.

6. Klient, którego stan wskazuje na spożycie alkoholu lub innych substancji psychoaktywnych nie może przebywać na terenie Klubu.

7. Klub nie udostępnia na sali treningowej miejsca na przechowanie rzeczy osób biorących udział w kursach. Rzeczy wartościowe należy zabrać ze sobą na salę treningową.

§5 Opłaty

1. Członek Klubu zobowiązany jest do wszystkich opłat członkowskich w kwocie i na warunkach płatności wskazanych w cenniku.

2. Aktualny cennik opłat jest dostępny stronie internetowej Klubu. W razie wątpliwości osoba zainteresowana zostaniem Członkiem Klubu może uzyskać wszelkie informacje dotyczące członkostwa w recepcji Klubu.

3. Klub zastrzega sobie prawo do zmiany cen. Zmiana cennika w trakcie trwania Umowy nie wpływa na jej postanowienia.

4. Klub jest uprawniony do odmowy wpuszczenia Członka Klubu na teren obiektu, gdy zalega on z opłatą członkowską.

5. W przypadku zakupu Karnetu lub usługi jednorazowej, Klient dokonuje opłaty w recepcji Klubu lub przez formularz płatności on-line na stronie Klubu zgodnie z obowiązującym cennikiem.

6. W przypadku usługi cyklicznej Klient podaje dane karty płatniczej w formularzu płatności on-line. Dane są przetwarzane bezpośrednio przez pośrednika płatności, bez udziału Klubu.

7. Karnet jest ważny 30 dni od dnia zakupu.

8. Karnet opłacany w formie cyklicznej można anulować przy zachowaniu 14 dniowego okresu wypowiedzenia.

9. Karnet można zawiesić maksymalnie dwa razy w ciągu roku kalendarzowego na łączny okres nie dłuższy niż 60 dni. Karnet zostanie zawieszony nie później niż po 14 dniach od dnia otrzymania prośby.

10. Prośby o anulowanie lub zawieszenie karnetu należy kierować drogą mailową na adres: hello@unityjiujitsu.pl  

11. Klient ma prawo złożyć reklamację drogą mailową na adres:  hello@unityjiujitsu.pl Reklamacja zostanie rozpatrzona do 14 dni roboczych od jej złożenia.

§6 Bezpieczeństwo

1. Klub informuje, iż dochowa wszelkiej staranności w celu maksymalnego zabezpieczenia klienta Klubu. Jednocześnie klient deklaruje, iż nie będzie rościł sobie prawa do odszkodowania i zadośćuczynienia w przypadku doznania kontuzji lub uszczerbku na zdrowiu, który został doznany w wyniku niedostosowania się do poleceń i uwag instruktora lub korzystania ze sprzętu w sposób niezgodny z instrukcją. Klient powyższe akceptuje, podczas akceptacji Regulaminu i nie wnosząc do niego uwag.

2. Klub informuje, iż dochowa wszelkiej staranności w celu maksymalnego zabezpieczenia miejsca prowadzenia zajęć. Zastrzega się, by nie pozostawiać wartościowych rzeczy bez nadzoru i zabierać takowe ze sobą na salę, w celu zminimalizowania ryzyka kradzieży oraz zgubienia cennych rzeczy. Klient deklaruje, że nie będzie rościł sobie prawa do odszkodowania w przypadku, gdy kradzież, uszkodzenie lub zaginięcie pozostawionych na terenie placówki rzeczy nastąpi w momencie, gdy nie dochował szczególnej staranności w celu ich zabezpieczenia (zabrania ich ze sobą na salę), mimo zaleceń ze strony Klubu. Klient powyższe akceptuje, podczas akceptacji Regulaminu i nie wnosząc do niego uwag.

3. Klub informuje, że teren placówki jest monitorowany ze względów bezpieczeństwa. Przebywanie na terenie placówki jest rejestrowane (audio i video) ze względów bezpieczeństwa za pomocą kamer. Ma to posłużyć w przypadku jakichkolwiek sporów prawnych jako materiał dowodowy. Jest to działanie jedynie prewencyjne w trosce o najwyższą jakość świadczonych usług. Jeśli nie wyrażasz zgody na nagrywanie, prosimy o opuszczenie placówki.

4. Teren Klubu jest w pełni terenem prywatnym i nie jest przestrzenią publiczną ani nie jest miejscem ogólnodostępnym. Na terenie Klubu znajdować się mogą tylko określone osoby, w określonych godzinach i spełniające określone kryteria wynikające z regulaminu Klubu. Nie jest dozwolone, by osoby postronne bez względu na reprezentowany podmiot mogły swobodnie poruszać się po terenie placówki. Każda próba zakłócenia pracy recepcji, trenerów lub administracji będzie skutkowała wezwaniem odpowiednich służb pod zarzutem utrudniania pracy oraz nękania. Każdorazowo będzie nakładana również kara dla osób postronnych utrudniających pracę, w skali godzinowej stawki względem dziennego obrotu Klubu jako zadośćuczynienie za zakłócanie poprawnej pracy Klubu i brakiem możliwości wykonywania swojej pracy.

§7 Ogólne warunki

1. Klient zobowiązany jest do przestrzegania postanowień Regulaminu Klubu.

2. Klient zobowiązany jest do ubezpieczenia się we własnym zakresie od następstw nieszczęśliwych wypadków oraz do wykonywania okresowych badań lekarskich.

3. Klient z przeciwwskazaniami zdrowotnymi do uczestnictwa w treningach sportów walki nie może brać udziału w zajęciach.

4. Osoba niszcząca mienie Klubu ponosi pełną odpowiedzialność za wyrządzone szkody. Za osobę niepełnoletnią odpowiedzialność materialną ponoszą ich rodzice lub opiekunowie prawni.

5. O wszelkich sytuacjach wymagających interwencji upoważnionych pracowników Klubu lub służb zewnętrznych należy natychmiast informować obsługę Klubu.

6. Wewnątrz Klubu obowiązuje zakaz fotografowania i filmowania bez uprzedniej zgody kierownictwa Klubu lub osoby upoważnionej.

7. Klub nie odpowiada za wypadki wynikłe z nieprzestrzegania niniejszego Regulaminu.

8. Przez zakup Karnetu lub wejście jednorazowego, Klient potwierdza, że zapoznał się z jego postanowieniami, zrozumiał je, akceptuje warunki i zobowiązuje się do ich przestrzegania.

9. Klub zastrzega sobie prawo do wprowadzania zmian w niniejszym Regulaminie.

10. Zmiany w cenniku lub w zakresie świadczonych usług nie stanowią zmiany Umowy i Regulaminu.

11. Zmiany w danych rejestrowych i adresowych Klubu nie wymagają zmiany Regulaminu.

12. Wszelkie zmiany Regulaminu wymagają poinformowania o nich Klientów poprzez doręczenie treści zmienionego Regulaminu w Klubie lub na stronie internetowej Klubu.

13. W sprawach nieuregulowanych w niniejszym Regulaminie zastosowanie mają przepisy Kodeksu cywilnego.

Niniejszy Regulamin wchodzi w życie z dniem 01.07.2025

Terms and conditions constitute a contract template within the meaning of art. 384 of the Civil Code and define the rights and obligations of the parties. Terms and conditions also apply to all promotional campaigns organized by Unity Jiu-Jitsu Kraków. By using the services, the services provided by the Unity Jiu-Jitsu Kraków customer concludes an agreement with the UNITY JIU JITSU LTD, company based in Kraków, Wielicka 42A/U3-U5 street, 33-552, using the NIP number: 6793333520, REGON: 541996549, KRS: 0001177943. The content of terms and conditions is available on the Unity Jiu-Jitsu Krakow website as well as at the Unity Jiu-Jitsu Krakow premises located at Wielicka 42A/U3-U5, 30-552 Kraków.

I declare that I read and accept Terms and Conditions.

I declare that playing or not playing any music at Unity Jiu Jitsu Kraków martial arts club doesn't influence my decision about buying the membership or any other Club's services.

§1 Definitions

1. Club – Unity Jiu-Jitsu Kraków martial arts club located at Wielicka 42A/U3-U5, 30-552 Kraków

2. Agreement – an agreement concluded with the UNITY JIU JITSU LTD that allows Customer to use the services provided by the Club, under the conditions set forth below

3. Customer – a person who uses the services provided by the Club

4. Club Member – a person who concluded agreement with the Club for the use of the services provided by the Club services for a fixed period of time.

5. Membership Card – a card issued by the Club for the Club Member authorizing him to use the services provided by the Club

6. Trainer – a person who conducts the martial art courses

§2 Range of services

1. The Club provides martial arts training courses.

2. A Customer has the right to use the services provided by the Club on the basis of the concluded Agreement.

3. The services provided by the Club shall only be possible either by having a valid Membership  Card or by paying a one-time fee at the reception desk or on-line in accordance with the applicable price list (one-time entry).

4. The Club declares that Trainers conducting the training courses have the knowledge and experience adequate for conducting such courses.

5. The Club declares that the services provided include the opportunity to use the equipment available on its premises, and the classes held at the Club are technical sessions based on specific techniques or technical elements of a sporting nature.

6. The Club does not offer its Customers exercise classes that use music. The presence or absence of music is not considered a part of the service, and the Customer declares that the presence or lack of music does not influence their decision to purchase a membership. The Customer has also been informed that some staff members at the Club listen to music for the purpose of improving their own mood. The Customer accepts this declaration by agreeing to the Terms and Conditions.

7. The Trainer at the Club conducts technical classes. Any music played in the background, if used, is solely for the Trainer’s personal use to make their time between teaching individual techniques more enjoyable. It is also used by many Trainers as a way to manage stress during presentations in front of the group. The Customer acknowledges this, stating that it does not influence their purchasing decision, which they confirm by accepting the Terms and Conditions and not raising any objections to them.

§3 Services for Club Members

1. A person who applies for the Club Member Status must present an ID card or other identity document containing a photograph in order to verify his identity.

2. Each Club Member shall receive a Membership Card at the Club’s reception desk or through the WodGuru online system.

3. The Membership Card is personal and cannot be passed to other people.

4. The Club Member must present their Membership Card on each occasion they use Club services. The club shall deny entry to the Club Member if he does not show his Membership Card.

5. Each Party is entitled to terminate the Agreement with immediate effect for important reasons such as:

– The Club Member infringes terms and conditions  and does not cease to do so, even after receiving a warning from the Club,

– The Club infringes terms and conditions and does not cease to do so, even after receiving a warning from the Club Member.

§4 Rules of using the Club services

1. A Customer who uses the services provided by the Club shall use the Club’s equipment only under the supervision of Trainer.

2. Before using the services provided by the Club, a Customer must declare that he has no contraindications that would prevent him from participating in a training course. If such contraindications exist, the Customer must inform the person Trainer about them. The declaration must be submitted in document form.

3. A Customer must comply with instructions issued by a Trainer or staff of the Club.

4. The Trainer has the right to limit the number of people in training room or ask Customer to leave the classes if, in the Trainer’s opinion, the Customer does not follow the trainer’s instructions.

5. It is forbidden to enter the training mat in any footwear.

6. A Customer whose behavior indicates the consumption of alcohol or other psychoactive substances cannot stay at the Club’s premises.

7. The Club does not provide space in the training room for storing personal items. Valuable items shall be taken by the Customer to the training space.

§5 Fees

1. The Club Member must pay fees according to the terms indicated in the price list.

2. Current prices of Membership Card or one-time entry are available at the Club’s reception and on the Club’s website. In case of doubt, a person interested in becoming the Club Member should obtain all the information regarding membership at the reception desk.

3. The Club reserves the right to change the prices. Changing the prices is not the change of the Agreement.

4. The Club has the right to deny entry to the Club Member who defaults on payment of Membership.

5. When purchasing the Membership Card or a one-time entry, Customer makes a payment at the Club reception or via the online payment form on the Club website.

6. In the case of a cyclical service, the Club Member provides payment card details in the online payment form. The payment card data is processed directly by the payment provider, without the participation of the Club.

7. Membership Card is valid for 30 days from the date of purchase.

8. A Membership Card paid in the form of a recurring payment may be canceled with 14 days notice.

9. A Membership Card paid in the form of a recurring payment may be suspended up to twice a calendar year for a total period of not more than 60 days.

10. In order to suspend or cancel a monthly membership paid in the form of a recurring payment, Club member must send an e-mail request to: hello@unityjiujitsu.pl

11. A Customer can issue a complaint by sending an e-mail to: hello@unityjiujitsu.pl The complaint will be answered within 14 business days.

§6 Safety

1. The Club informs that it will exercise all due diligence to ensure maximum protection of the Club's Customers. At the same time, the Customer declares that they will not claim compensation or reparation in the event of injury or harm to health caused by failure to follow the instructor’s instructions or improper use of equipment. The Customer accepts this upon accepting the Terms and Conditions and without making any objections to them.

2. The Club informs that it will exercise all due diligence to ensure maximum safety in the area where classes are conducted. It is advised not to leave valuable items unattended and to take them into the training area to minimize the risk of theft or loss of valuable items. The Customer declares that they will not claim compensation in the event of theft, damage, or loss of items left on the premises of the Club if they did not take due care to secure them (by taking them into the training area), despite recommendations from the Club. The Customer accepts this upon accepting the Terms and Conditions and without making any objections to them.

3. The Club informs that the premises are monitored for safety reasons. Presence on the premises is recorded (audio and video) for security purposes using cameras. This is done as preventive action to ensure the highest quality of services provided and may be used as evidence in the case of any legal disputes. If you do not consent to being recorded, please leave the Club premises.

4. The Club's premises are fully private and are not a public space or a freely accessible area. Only specific individuals are allowed on the premises, at specified times, and must meet the criteria set out in the Club’s regulations. It is not permitted for unauthorized persons, regardless of the entity they represent, to freely move around the facility. Any attempt to disrupt the work of the reception, Trainers, or administration will result in the authorities being called on the grounds of obstruction and harassment.

§7 General conditions

1. A Customer must comply with the terms and conditions.

2. A Customer must buy an insurance for himself against the consequences of accidents and to perform periodic medical examinations.

3. A Customer with health contraindications shall not participate in the training course.

4. A person that destroys the Club’s property shall be fully liable for any damage caused. Parents or legal guardians bear material responsibility for minors.

5. The Club’s staff should be immediately informed about any situations requiring the intervention of authorized Club’s employees or external services.

6. It is forbidden to film or make photos inside the Club’s premises without the prior consent of the Club’s management or an authorized person.

7. The Club is not responsible for accidents resulting from non-compliance with terms and conditions.

8. By purchasing the Membership Card or paying for one-time entry, a Customer confirms that he has read its provisions, understood them, accepts the terms and conditions and undertakes to comply with them.

9. The Club reserves the right to change terms and conditions

10. Changes in the price list or in the range of services provided by the Club is not a change to the Agreement.

11. Changes to the Club’s registration and address details do not require a change to the terms and conditions

12. If any change is made to the Agreement, the Club shall provide the content of the changed Agreement in the Club’s premises or on the Club’s website.

Terms and conditions shall enter into force on 01.07.2025
